These Terms of Service govern your use of the ACT Jobs platform (airconsulteam.com and app.airconsulteam.com), operated by Airconsulteam Media Ltd. By registering, you agree to these terms.
Part A — Workers
A1. Eligibility
You must be aged 18 or over and have the legal right to work in the UK. You must complete our verification process (identity, Right to Work, DBS) before accepting paid shifts.
A2. Employment status
ACT Jobs operates as an employment agency under the Conduct of Employment Agencies and Employment Businesses Regulations 2003. When you accept and work a shift, you are a worker engaged by Airconsulteam Media Ltd for that specific engagement only. There is no mutuality of obligation between shifts — we do not guarantee work and you are not obliged to accept shifts. Income tax and National Insurance contributions are deducted at source (PAYE). You will receive a payslip for every completed shift.
A3. Same-day pay
Payment is processed following clock-out. Same-day pay is subject to your bank account being verified and your shift being confirmed by the employer. ACT Jobs targets payment within 2–4 hours of clock-out on working days. Bank processing times are outside our control.
A4. Your obligations
- Provide accurate personal, RTW, and banking information
- Arrive on time and complete booked shifts unless you cancel with adequate notice via the app
- Behave professionally at employer sites
- Notify us immediately of any change to your Right to Work status
A5. Cancellations
Cancellations made less than 4 hours before a shift starts may result in a temporary restriction on your account. Repeated no-shows may result in account suspension.
A6. Holiday pay
You accrue statutory holiday pay at 12.07% of your earnings for each shift, calculated in accordance with the Working Time Regulations 1998 as interpreted by Harpur Trust v Brazel [2022] UKSC 21 for workers with irregular hours. Holiday pay is included in your gross pay as a rolled-up element and is itemised on your payslip. This rolled-up holiday pay arrangement applies to irregular-hours and part-year workers as expressly permitted under the Working Time Regulations 1998 (as amended by the Employment Rights (Amendment, Revocation and Transitional Provision) Regulations 2023, in force from 1 April 2024). You may not carry over untaken holiday unless prevented from taking it due to sickness or other statutory reason.
A7. Pension auto-enrolment
You may be eligible for automatic enrolment into a workplace pension in accordance with the Pensions Act 2008 and the Occupational Pension Schemes (Automatic Enrolment) Regulations 2010. We will assess your eligibility based on your earnings and age. If you qualify, we will enrol you and provide a separate pension notice. You have the right to opt out within one month of enrolment.
A8. National Minimum Wage
All shifts are paid at or above the applicable National Minimum Wage or National Living Wage rate in force at the time of the shift, as set by the Low Pay Commission under the National Minimum Wage Act 1998. Your payslip will confirm the hourly rate applied. If you believe you have been paid below the statutory minimum, contact us immediately at hello@airconsulteam.com.
A9. Agency Workers Regulations
After 12 continuous calendar weeks in the same role with the same hirer, you are entitled to equal treatment as a comparable permanent employee under the Agency Workers Regulations 2010. This includes equal pay, working time, rest periods, and annual leave entitlement. ACT Jobs tracks your qualifying weeks automatically and will notify you when you reach the 12-week threshold. A10. Equal opportunities
ACT Jobs is committed to equal opportunities for all workers. We do not discriminate on the basis of age, disability, gender reassignment, marriage or civil partnership, pregnancy or maternity, race, religion or belief, sex, or sexual orientation, as defined under the Equality Act 2010. Part B — Employers
B1. Platform access
Employer access is provided under a subscription plan (PAYG, Starter, Growth, or Enterprise) as described on our pricing page. Plans are billed monthly and renew automatically unless cancelled.
B2. Staffing margin
In addition to the platform subscription fee, ACT Jobs applies a transparent margin multiplier to the worker’s hourly wage for each shift. This covers PAYE payroll, employer NI contributions, compliance, and platform infrastructure. The applicable multiplier for your plan is shown on the pricing page and confirmed in your employer agreement.
B3. Employer obligations
- Provide accurate shift details including location, start time, duration, and role requirements
- Ensure your site is safe and compliant with health and safety legislation
- Confirm or dispute shift completion within 24 hours of clock-out
- Pay invoices within 14 days of issue
- Not discriminate against any worker on the basis of a protected characteristic as defined under the Equality Act 2010
- Pay workers at or above the National Minimum Wage or National Living Wage applicable at the time of the shift
- Respect agency workers’ equal-treatment rights under the Agency Workers Regulations 2010 once the 12-week qualifying threshold is reached
B3a. Equal opportunities (employers)
Employers using ACT Jobs must not discriminate against workers or applicants on the basis of age, disability, gender reassignment, marriage or civil partnership, pregnancy or maternity, race, religion or belief, sex, or sexual orientation under the Equality Act 2010. Employers must not request workers with specific protected characteristics (e.g. “only young workers” or “male only”) unless a genuine occupational requirement exists and has been agreed with ACT Jobs in writing in advance. Breach of this obligation may result in immediate suspension of employer access.
B4. Cancellations by employer
Shifts cancelled less than 4 hours before start may incur a cancellation charge equivalent to 2 hours of the worker’s rate. This compensates workers for lost earnings.
B5. Subscriptions and billing
Monthly subscriptions are processed by Stripe. You will receive a reminder at least 5 working days before each automatic renewal, in accordance with the Digital Markets, Competition and Consumers Act 2024. You may cancel at any time before renewal; cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
B6. SLA commitment
ACT Jobs aims to provide candidate matches within 2 hours of shift posting during working hours (Mon–Sat, 07:00–22:00). This is a target, not a guarantee.
Part C — General
C1. Acceptable use
You may not use the platform to circumvent our matching system, contact workers or employers directly to arrange off-platform engagements, or post false information.
C2. Intellectual property
All content, design, and software on the ACT Jobs platform is owned by Airconsulteam Media Ltd. You may not copy, reproduce, or distribute any part of the platform without written permission.
C3. Limitation of liability
To the fullest extent permitted by law, Airconsulteam Media Ltd is not liable for indirect, incidental, or consequential losses arising from use of the platform. Our total liability in any 12-month period is limited to the fees you have paid to us in that period.
C4. Termination
We reserve the right to suspend or terminate accounts that breach these terms, engage in fraudulent activity, or misuse the platform.
C5. Dispute resolution
Before initiating any legal proceedings, both parties agree to attempt resolution in good faith within 30 days of one party giving written notice of a dispute to the other. Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief.
C6. Force majeure
Neither party shall be liable for failure or delay in performance caused by circumstances beyond their reasonable control, including but not limited to acts of God, pandemic, government action, internet outages, or third-party service failures, provided the affected party notifies the other promptly and uses reasonable endeavours to mitigate the effect.
C7. Data protection
Personal data collected and processed in connection with your use of the platform is handled in accordance with our Privacy Notice, available at airconsulteam.com/privacy.html. Airconsulteam Media Ltd is the data controller. Both parties agree to comply with applicable data protection legislation, including UK GDPR and the Data Protection Act 2018.
C8. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
C9. Changes to terms
We may update these terms periodically. Registered users will be notified by email at least 14 days before material changes take effect.
